Programme Terms & Conditions
These Terms & Conditions apply to all private art programmes, art tours and cultural experiences (the "Programme") provided by ARTLEVEL FZCO, licence 33567, IFZA Business Park, Dubai Silicon Oasis, Dubai, United Arab Emirates ("ArtLevel"), to the person named in the invoice (the "Client"). By paying an ArtLevel invoice, the Client confirms that they have read and accepted these Terms & Conditions.
1. THE PROGRAMME
1.1. The Programme is an independent private programme designed and delivered by ArtLevel. Where it takes place during an art fair or another public event (for example, Frieze Abu Dhabi), ArtLevel is not affiliated with the organiser of that event unless expressly stated in writing.
1.2. The cancellation, postponement or change of such an event does not by itself cancel the Programme. In that case ArtLevel will deliver the Programme with an adjusted itinerary of comparable value, which may include museums, galleries, private collections, studio visits and meetings with art professionals.
1.3. ArtLevel may adjust the itinerary and replace any venue, visit, speaker or service with an equivalent experience where circumstances require.
2. PRICE AND PAYMENT
2.1. The price of the Programme is stated in the invoice and is payable in full by the date indicated in it. The Client's place is confirmed once payment is received.
2.2. Thirty percent (30%) of the price is a planning fee covering research, curatorial planning, coordination and reservations (the "Planning Fee"). The Planning Fee is earned upon payment and is non-refundable, except as stated in clause 5.
2.3. Unless stated otherwise in the invoice, the price does not include flights, accommodation, visas, insurance, personal expenses or the purchase of artworks.
3. CANCELLATION BY THE CLIENT
3.1. The Client may cancel by written notice to artlevel3003@gmail.com.
3.2. Cancellation 30 days or more before the start of the Programme: refund of the price less the Planning Fee.
3.3. Cancellation 14 to 29 days before the start: refund of 50% of the price.
3.4. Cancellation less than 14 days before the start, or non-attendance: no refund.
3.5. With ArtLevel's prior written consent, the Client may transfer their place to another person at no extra charge.
4. FORCE MAJEURE
4.1. Force majeure means any event beyond the reasonable control of ArtLevel, including hostilities, military action, terrorism, civil unrest, government restrictions or travel advisories, closure of airspace or borders, epidemics and natural disasters.
4.2. If a force majeure event prevents the Programme from taking place as scheduled, ArtLevel will offer the Client, at the Client's choice: (a) participation on new dates; or (b) a credit for the full amount paid, valid for 12 months and applicable to any ArtLevel programme or service.
4.3. If the Client declines both options in writing within 14 days of ArtLevel's offer, ArtLevel will refund the amount paid less the Planning Fee and any documented non-refundable costs already paid to third parties, within 30 days.
4.4. Neither party is liable for any delay or failure to perform caused by force majeure.
5. CANCELLATION BY ARTLEVEL
If ArtLevel cancels the Programme for reasons other than force majeure and cannot offer new dates acceptable to the Client, ArtLevel will refund the amount paid in full.
6. THIRD PARTIES AND LIABILITY
6.1. Venues, collections, galleries, transport and hospitality services are operated by third parties. ArtLevel coordinates access to them but is not responsible for their acts, omissions or decisions to close or change access.
6.2. ArtLevel's total liability in connection with the Programme is limited to the amount paid by the Client.
7. GOVERNING LAW
These Terms & Conditions are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute shall be referred to the courts of Dubai.
